Back to that sterling example of the Jurors being pricks – Brian Deneke.

They admitted if it had been the other guy dead in a parking lot and Deneke driving away, then they’d have gone Murder 1 with Death penalty advised.

Juries don’t have a hard job when they get to walk away proudly proclaiming their manifest prejudice.

No… Froofrou used it correctly since you are stating that more child molesters would just kill their victims thus adding an element to attack that she didn’t present in the first place. Smells of straw to me.

Realistically, threat of punishment doesn’t stop a criminal. It is the punishment itself that stops it from happening again, if only for a short period of time. So if the child molester was going to kill his or her victims, they were going to do it anyway.

The random serial sexual attacker will often kill simply to protect their identity, unlike the selective, who believes they are forging some form of relationship, or they simply don’t see the attack as an ‘attack’.

As a personal opinion, there is little room for ‘anger’ in the law. Compassion is a pre-requisite, since, in many respects, the legal system around sexual attacks and more general murders were enacted to be ‘better’ than a mob… if one is going to simply legislate to pander to the mob, then one may as well just have the mob and cut out the middle man…

Usually in these conversations someone comes out with the old straw man what if it were your wife/daughter/mother… the obvious answer is something muscular and bellicose to prove one has the balls. The converse question is not asked: What if it were your father/brother/son on death row for a crime he didn’t commit, but the court found him guilty for what ever reason? What then?

Actually, I think just executing the prosecuting attorney would be sufficient, since, ideally, the others are just doing the job set in front of them. The prosecuting attorney is the one who gets to request the death penalty over life in prison, at least in the US.

Froo, I don’t disagree with you at all about what to do with predators we catch in the act. I just can’t think of any instances where that has occured. Plus, if these predators know what will happen to them when they get caught, they’re more likely to try to kill others instead of giving up, which I don’t think anybody wants.

I’m not against the death penalty, per se. I just believe that even one wrongly executed person is too many. Right now, capital punishment is actually more expensive than life imprisonment, and we *still* have wrongful executions. Relaxing the legal requirements, in order to cut the costs of execution, would just make the problems worse.

I’m forced to conclude that, barring any instances of absolute certainty regarding the guilt or innocence of a given criminal, the costs of execution are too high. We’re better off locking these SOBs up and throwing away the key.
